PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

Please Read Carefully Before Signing

This Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement ("Agreement") is entered into by the undersigned participant ("Participant") and Utah Hockey Lab, its owners, officers, directors, employees, contractors, trainers, coaches, agents, affiliates, landlords, sponsors, volunteers, and representatives (collectively, "Utah Hockey Lab").

1. ACKNOWLEDGMENT OF RISKS

I understand and acknowledge that participation in activities at Utah Hockey Lab involves inherent risks, dangers, and hazards that may result in serious injury, permanent disability, illness, property damage, paralysis, or death.

These risks include, but are not limited to:

• Hockey training activities
• Shooting drills
• Skating activities
• Synthetic ice usage
• Treadmill skating systems
• Training aids and shooting machines
• Puck rebound systems
• Fitness and strength training
• Agility and conditioning exercises
• Resistance training
• Team practices
• Camps, clinics, lessons, and events
• Open training sessions
• Use of locker rooms, restrooms, common areas, and facility equipment
• Slips, trips, falls, collisions, and contact with other participants
• Equipment malfunction or misuse
• Flying pucks, sticks, balls, or other projectiles
• Uneven surfaces or facility conditions
• Acts or omissions of other participants

I understand that injuries can occur regardless of the care taken by Utah Hockey Lab or its staff.

2. ASSUMPTION OF RISK

I knowingly and voluntarily assume all risks associated with participation in any activities conducted by or at Utah Hockey Lab.

I acknowledge that:

• Participation is voluntary.
• I am physically capable of participating.
• I have consulted a physician if necessary.
• I understand the risks involved.
• I choose to participate despite those risks.
• I assume full responsibility for any injury, loss, damage, illness, or death that may occur.

3. RELEASE OF LIABILITY

To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue Utah Hockey Lab from any and all claims, demands, causes of action, damages, losses, liabilities, costs, expenses, attorney fees, or injuries arising out of or related to:

• My participation in any activity.
• My presence at the facility.
• Use of any equipment.
• Instruction, coaching, or supervision.
• Facility conditions.
• Negligence of Utah Hockey Lab.

This release applies whether the claim arises from ordinary negligence or otherwise, except where prohibited by law.

4. MINOR PARTICIPANTS

If signing on behalf of a minor participant:

I certify that I am the parent or legal guardian of the minor.

I agree:

• To all terms of this Agreement on behalf of the minor.
• To assume all risks on behalf of the minor.
• To release Utah Hockey Lab from claims arising from the minor's participation.
• To indemnify Utah Hockey Lab against claims brought by or on behalf of the minor.

5. MEDICAL TREATMENT AUTHORIZATION

I authorize Utah Hockey Lab and its representatives to obtain emergency medical treatment if deemed necessary.

I understand that:

• Utah Hockey Lab has no obligation to provide medical care.
• Any medical expenses incurred are solely my responsibility.
• Emergency services may be contacted without prior notice.

6. EQUIPMENT RESPONSIBILITY

I understand that:

• I am responsible for ensuring my equipment is properly fitted and maintained.
• Utah Hockey Lab does not guarantee the safety or condition of participant-owned equipment.
• I am responsible for damage caused by misuse of facility equipment.

7. FACILITY RULES

I agree to:

• Follow all facility policies and posted rules.
• Follow instructions from staff and coaches.
• Use equipment only as intended.
• Maintain appropriate conduct.
• Refrain from reckless or dangerous behavior.
• Respect all participants, staff, and property.

Utah Hockey Lab reserves the right to remove any participant without refund for unsafe, disruptive, or inappropriate behavior.

8. PROPERTY DAMAGE

I accept responsibility for damage caused by myself, my guests, or my minor children.

I agree to reimburse Utah Hockey Lab for repair or replacement costs resulting from intentional damage, negligence, or misuse.

9. PHOTO, VIDEO, AND MEDIA RELEASE

I grant Utah Hockey Lab permission to photograph, record, and use my image, voice, likeness, performance, or participation for:

• Marketing
• Advertising
• Social media
• Website content
• Promotional materials
• Educational purposes

I waive any right to compensation or approval regarding such use.

10. MEMBERSHIP AND BOOKING ACKNOWLEDGMENTS

For members, guests, teams, event attendees, renters, and booking parties:

I acknowledge that:

• Memberships and bookings may be subject to separate terms and policies.
• Utah Hockey Lab may modify facility hours, services, equipment, programs, and amenities.
• Access may be restricted for maintenance, events, safety concerns, or operational needs.
• No guarantee is made regarding availability of specific equipment or training areas.

11. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless Utah Hockey Lab from any claims, demands, lawsuits, damages, costs, or expenses arising from:

• My actions or omissions.
• My participation.
• The participation of my minor child.
• Any claim brought by third parties related to my conduct.

12. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Utah.

Any dispute arising from this Agreement shall be brought exclusively in a court located within the State of Utah.

13. SEVERABILITY

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties regarding liability and risk assumption and supersedes all prior oral or written agreements related to these matters.
